EPA has indicated that they intend to develop a guidance document on developing water quality based pollutant discharge limits and permit conditions to reduce nutrients from industrial and publically-owned wastewater treatment plants. This guidance is a follow up on a document developed by EPA headquarters on a recommended framework for managing nutrients, which was recently sent to state official and regional administrators. More specifically, the guidance will focus on one element of this recommended framework that addresses targeted sub-watersheds that receive significant nutrient loadings from wastewater sources. Policy issues that may be included in the guidance includes the relationship between state standards and numeric water quality based effluent limitations, clarification on the "reasonable potential" to exceed nutrient limits without proper modeling or monitoring data, and how the effluent limitations should be developed. EPA expects the guidance to be finalized by May, 2012.
