WEF, NACWA and AWWA are jointly hosting a webinar on EPA’s 2022 Proposed Financial Capability Assessment (FCA) Guidance.

For utilities facing Clean Water Act enforcement actions that could impose significant compliance costs, note that EPA has substantially changed its guidance on how community financial capabilities used to guide compliance scheduling will be assessed.  This seminar will discuss major concerns, missed opportunities, and potential implications of the guidance revisions and is hosted by WEF, NACWA and AWWA jointly.

The webinar is intended to assist those wishing to better understand the changes EPA is proposing and assist those considering submitting comments to the agency on this guidance. Public comments on the proposed guidance are due by April 25, 2022

The 2022 Proposed Financial Capability Assessment (FCA) Guidance, were published in the Federal Register on February 23, 2022.  These guidance would replace the 1997 FCA guidance and the updated guidance initially finalized and disseminated in January 2021.  The proposed 2022 FCA guidance, are substantially changed from the agency’s 2021 guidance.  These changes fail to respond to many of the methodological and procedural improvements to the original 1997 FCA guidance recommended by the National Academy of Public Administrators, U.S. Council of Mayors, and the water sector associations.
